At trial, less is usually more. That's definitely true with the exhibits you use. Our securities arbitration cases are very document intensive. And we don't have the benefit of depositions in our cases, which makes preparing for witnesses a challenge. Because of that, most defense firms bring everything to trial. Lawyers roll in with 20 huge binders, ready to throw everything they have into evidence. On some level, that's understandable. You never want to suddenly realize that a critical document is sitting back at the office. That's not a good feeling. But everything is too much. At trial, you want the judge, the jury, or the arbitrators only focusing on what is most important to your case. That's why we usually show up on day one with two binders containing 120 carefully selected exhibits. And while opposing counsel uses a tiny fraction of their exhibits, we typically use 90% of ours. For any lawyers starting to prepare cases for trial, remember that less is more. The things you leave out can be just as important as the things you bring to the table.
