Reclaiming the Offensive: Texas Plaintiff’s Lawyers Must Lead the Way ⚖️
Every session in Austin, plaintiff’s lawyers spend more time defending the status quo against attacks from big corporations and Republican legislators than actively pushing forward new laws that empower the injured, the worker, and the individual. Our lack of offensive moves has led to a legislative landscape where Pro-Plaintiff, Pro-Individual, and Pro-Worker bills struggle to gain traction. 🤨
But why does this matter?
Balancing the Scales of Justice: We’ve seen repeated attempts to cap noneconomic damages and restrict consumer rights—with minimal, if any, proactive measures proposed to strengthen legal protections for everyday Texans.
Protecting Ordinary Texans: From workplace injuries to product defects, real people rely on our legislative framework to ensure fair compensation and deterrence. According to the UT/Texas Politics Project Poll, most Texans want the Legislature focused on health care, education, and the economy — not weakening consumer protections.
Shaping Policy vs. Reacting to It: When we only react to bills that threaten civil justice, we concede the power of proactive policy-making. It’s time to turn the tables and push for stronger worker protections, clearer consumer rights, and higher standards of accountability for corporations.
What We Must Do:
✅ Collaborate: Form broader coalitions that include labor unions, consumer advocacy groups, and community organizations.
✅ Educate: Use social media, town halls, and professional networks to explain how seemingly “minor” tort reform bills can devastate a family’s ability to recover from a serious accident.
✅ Legislate: Craft bold, progressive proposals—raising caps on damages, strengthening workplace safety laws, and modernizing consumer protections—so the debate centers on our terms, not just the corporate agenda.
We owe it to our clients—and to future generations—to shape a legislative environment that values human life, work, and dignity. Let’s rally, go on the offensive, and champion legislative proposals that truly protect the rights of all Texans. 💪
